Optiway («Optiway», «Us», «We», and «Our») is committed to respecting and protecting Your privacy. In Our work, We strive to comply with all applicable laws to protect the privacy and security of Personal Data.

The Optiway Privacy Policy ("Policy") applies to all information Optiway collects via its websites (the "Website") and the Optiway mobile application (the "App"), and describes how we collect, use, protect and disclose Personal Data, including when data may be shared with third-party service providers.

You agree to this Policy, any other annexes to the Policy, and any other documents referred to in this Policy by using the App and/or utilizing Optiway's Services. If You do not agree to the terms of this Policy, You may not use the App or Optiway Services and You must immediately exit the App and cease using Optiway's Services.

Data Processing Principles

We adhere to the following principles to protect your privacy:

Principle of purposeful limitation — We process Personal Data fairly and transparently, solely for the achievement of specific, clear, and legitimate purposes, and We do not process them in a manner inconsistent with such data processing purposes.

Principle of data minimization — We collect Personal Data only to the extent necessary to achieve the defined purposes. We do not store Personal Data if it is no longer needed or if the purposes for which the Personal Data was collected have been achieved.

Principle of limited use — We use Personal Data for any other purpose only with the consent of the data subject or without such consent if the competent authority expressly permits it.

Principle of data quality — We always keep Personal Data up-to-date and complete to more effectively achieve the ultimate purpose of data processing.

Principle of security and integrity — We process Personal Data in a way that ensures adequate security of Personal Data, in particular their protection against unauthorized or unlawful processing and accidental loss, destruction, or damage, using appropriate technical and organizational measures.

Principle of individual participation — We inform Users about data collection. Users have the right to access their Personal Data and request the correction of inaccurate or misleading data.

Data Controller

Optiway acts as the Data Controller for personal data processed in the mobile App. When you enter third-party details (e.g., drivers or recipients), you confirm that you have a lawful basis to provide their data to us (e.g., consent or legitimate interests).

General Information

This Policy applies to any individual who uses the Services available on the App or otherwise uses the App («User», «You» and «Your»).

If You do not carefully read, do not fully understand, or disagree with the Privacy Policy, You must immediately stop using the App.

We assume that all Users have read this Policy carefully, understand its content, and agree to the terms and conditions outlined in this Policy. If You do not agree to this Privacy Policy, You must refrain from using the App.

We do not knowingly collect Personal Data from children under 16 in the EEA/UK without verifiable parental consent. If You believe such data has been provided to Us, please contact support@optiway-app.com and We will delete it.

Information We Collect

Optiway can acquire, store, process, use, and disclose Personal Data submitted by the User while using the App and/or Services. The User authorizes Optiway to receive, store, process, use, and disclose the User's Personal Data in accordance with the terms of this Policy by using any aspect of the App and/or Service. Optiway collects, stores, processes, and uses the User's Personal Data to allow Users to use the App and/or Services, as well as to defend the rights and legitimate interests of the User of Personal Data as set forth by law.

In certain U.S. states we treat precise geolocation as Sensitive Personal Data and obtain opt-in consent before processing. We do not use precise geolocation for cross-context behavioral advertising without consent.

We may collect and process the following Personal Data («Personal Data»):

Information You provide directly to Us:

Contact information – We collect Your contact information when You use, inquire about, or purchase Our Services. This information includes your email address.

Account information – We collect information about Your Optiway account («Account»). This information includes email address, password, user settings within the App, settings or preferences related to route optimization, User ID, date of account creation and details for Services purchased or subscribed to. You provide this information, except password, to Us directly during the account registration process, and when You log into the Services for the first time, We automatically receive this information. Please note that information such as Your password is collected and stored by the Auth0 service.

Route Creation and Optimization – When you create a route or use our route optimization services, we collect information related to the routes you create. This may include start and end points, waypoints, travel preferences, and other route-related data.

Social media information – We use social media features, such as the Telegram and the Instagram button widgets («Social Media Features»), and We receive information about You if the Social Media Features are hosted directly on Our Website. Your interactions with Social Media Features are governed by the privacy and user policies of the companies that provide them, and We are not responsible for how those companies collect, use, or disclose Your information. We encourage You to review the privacy notices of those companies before connecting to or using their Social Media Features to learn more about their privacy practices.

Information We collect automatically:

Usage information – This information includes operating system, device type, IP address, device identifiers and crash data. For the Website only, we may also collect browser type and referrer/exit URLs.

Device information – We collect information about the User's computer, phone, tablet, or other devices the User uses to access the Service. This device information includes the User's device ID, IDFA, connection type and settings when the User installs, accesses, updates, or uses Our Service.

Geolocation information — We collect information about the User's current location via the App if You grant Apple Location Services permission to the App. When You use certain Services, we use GPS (or other similar sensor technology) to collect sensor data and the precise geographic location of You or Your vehicle. We use precise geolocation strictly to provide routing and ETA. We do not use precise geolocation for cross-context behavioral advertising without your consent. Location access follows your device OS settings and can be disabled any time in App or system settings.

Application usage information – We collect application usage information for support purposes and improve Our Services. This information includes application crash reports or usage analytics.

Mobile SDKs and identifiers – The App may collect device identifiers (including advertising identifiers such as IDFA/GAID when permitted), installation and app instance IDs, and campaign/attribution data. Advertising identifiers are accessed only after AppTrackingTransparency (ATT) permission on iOS 14.5+ and after consent where required. We use SDKs for authentication/billing, analytics and performance, crash diagnostics, push notifications and in-app messages, attribution/measurement, and mapping/geolocation. Non-essential analytics/marketing SDK features are not enabled without consent where required by law.

Information We collect from third parties:

We receive information about Users from third parties or Optiway partners that provide services or support Our business operations. We limit Our use of Your Personal Data to the purposes described in this section. Personal Data that We receive from third parties includes:

  • Social media networks
  • Facebook, Google, Auth0, or Twitter accounts you can use to log in
  • Third-party libraries on iOS (e.g., analytics/diagnostics), which We enable only where permitted by law and, where required, with Your consent

We use this information in aggregate form to evaluate and improve Our content. We do not attempt to identify You from aggregated data, and will only combine it with other information where We have a legal basis (e.g., Your consent).

Purposes of Personal Data Collection

Mobile Data Summary:

Account data (email, user ID, in-app settings) → provide and support the App → kept for the life of the account and for a limited period thereafter to maintain records, resolve issues and comply with requirements → hosting/auth/billing providers.

Precise location (when enabled) → routing/ETA and core features → kept as long as needed to provide the route and related diagnostics, then deleted or aggregated → mapping/geolocation services.

Device/usage/diagnostics (IP, device IDs, crash/performance) → security, fraud prevention, debugging, service quality → kept until no longer necessary for these purposes, then deleted or aggregated → analytics/operations tooling; hosting.

Marketing/attribution identifiers (IDFA/GAID, campaign data) → used only with consent/ATT for analytics/attribution and, where applicable, advertising → kept while consent remains active and for a limited period after withdrawal to honor your choices → analytics/attribution providers.

Billing/subscription metadata (via app stores) → payments and compliance → kept as long as necessary to meet accounting, tax and chargeback requirements → app stores/payment processors.

Recipient categories: cloud hosting/infrastructure; authentication & payment; analytics/attribution; push & in-app messaging; mapping/geolocation; customer support tooling; professional advisers; public authorities where required.

We may use Your Personal Data for the following purposes:

  • ✅ To improve the Services, including testing, research, internal analytics and product development
  • ✅ For advertisement purposes
  • ✅ To personalize the Services, App content and messages based on Users' preferences
  • ✅ To protect against fraud activities, and provide security and bug fixes
  • ✅ To create and manage User accounts or other user profiles
  • ✅ To respond to User correspondence, contact Users when necessary or requested, and send Users information about the Services
  • ✅ To fulfill Our legal obligations under applicable law, regulation, court order or other legal process, such as preventing, detecting and investigating security incidents and potentially illegal or prohibited activities
  • ✅ To enforce any agreements with Users
  • ✅ To respond to claims that any publication or other content violates the rights of third parties

  • ✅ To fulfill other business purposes stated when collecting Users' Personal Data or as otherwise set forth in applicable data privacy laws

Methods and Terms of Processing Personal Data

We process Personal Data using appropriate technical and organizational measures, with and without automated means, only for the purposes described in this Policy. Personal Data may be disclosed to competent public authorities only where required by law.

Cookies (Website Only)

We use cookies and similar technologies on our Website to make the site work properly and to measure performance. Non-essential cookies are off by default and are enabled only if you choose Accept on the cookie banner. If you choose Reject, only essential cookies remain active.

Categories:

Essential – Required for security, load balancing, and basic site functionality.

Analytics – Used to understand visits, page views, and performance.

Marketing (if any) – Used to measure traffic sources and basic campaign reach.

Similar technologies: We may also use pixels, tags, or local storage for the same purposes.

Third parties: Some cookies are set by trusted service providers (e.g., analytics, hosting, tag management) and run only after you select Accept where consent is required.

Retention: Cookies are stored only as long as needed for their purpose; you can clear them at any time in your browser settings.

Changing your choice: You can reopen the cookie banner (if available in the footer) or clear cookies in your browser to withdraw consent.

U.S. Notice at Collection (Mobile)

Categories collected: identifiers (email, device/advertising IDs), app activity (usage, crash logs), precise geolocation (opt-in), subscription information, limited inferences.

Purposes: provide and improve the App, security/fraud prevention, support, and (with consent) analytics/attribution/advertising.

Retention: by the criteria described in the Summary above.

Sale/Share: We do not sell personal information. You may opt out of "sharing" for cross-context behavioral advertising via in-App Settings → Privacy (and platform ad settings).

Sensitive information: You may limit the use of precise geolocation by turning off location permissions or in-App controls.

Note: Browser GPC signals do not apply in the mobile App; use in-App and OS privacy controls.

The Rights of Users

Users may review, correct, update, delete and transmit their Personal Data.

Subject to possible restrictions under applicable national law of the data subject You may have certain rights regarding the Personal Data that We collect on You, particularly:

Right to object to the processing of Your Personal Data. Users have the right to object to Our processing of their Personal Data by contacting Us at support@optiway-app.com. Once We receive an objection, We will no longer process Your Personal Data unless it is necessary to provide Our Services or We demonstrate other legitimate grounds for Our processing that override Your interests, rights, and freedoms or for legal proceedings.

Right to access Your Personal Data. Users have the right to find out whether We process their Personal Data, what categories of Personal Data We process about them, the purposes of the processing, the categories of third parties to whom We may disclose the Personal Data of Users, the storage period of their Personal Data or the criteria for determining it by contacting Us at support@optiway-app.com.

Right to verification and correction. Users have the right to verify their Personal Data's accuracy and request its update or correction. Upon receipt of such a request, We have the right to verify the grounds for updating or correcting Personal Data and request additional information and documents from You that confirm such grounds. If there are sufficient grounds to update or correct Personal Data, We will make the necessary changes as soon as possible.

Right to restrict the processing of Your Personal Data. Users have the right, under specific circumstances, to request that We restrict the processing of their Personal Data as required by applicable data protection laws, such as when Our processing is unlawful. In this case, We will not process Your Personal Data for any purpose other than to store it.

Right to receive Your Personal Data and to transmit it to another Controller. Where Our processing is based on Your consent and is carried out by automated means, You have the right to receive Your Personal Data in a structured, commonly used, and machine-readable format and, where technically feasible, to transmit it to another Controller without any hindrance.

Right to withdraw consent. Where Our processing is based on Your consent, You may withdraw Your consent at any time.

You also have the right to file a complaint with a supervisory authority if You believe We are violating Your rights. But We ask You to contact Us first so that We can help You.

When We receive any User's request to access, edit or delete personally identifiable information, We reserve the right to initially take reasonable steps to verify Your identity before granting You access or otherwise taking action. This is essential to protect Your information.

You also have the right to contact Us using the Contact Form. To do this, You need to specify Your email and name. We use Personal Data collected only to contact You as You await Our response to Your request, and We may also record Your request and Our response to improve the efficiency of the organization and operation of Our support service. We store information that can be used to identify You personally associated with Your request, such as Your email, name and/or phone number (if You have provided Us with such data), so that We can contact You and provide You with quality services. If You do not wish Us to collect Your Personal Data, please do not use Our Contact Form and do not give Your consent.

We respond to privacy requests without undue delay and within a reasonable timeframe. If we need more time due to complexity or volume, we will let you know and explain why.

Advertising Offers and Informational and Marketing Messages

We may send marketing and informational messages to Users through email. Where required by law, We ask for Your explicit consent to receive such messages. When We send You messages, We aim to include the link «Unsubscribe» at the bottom of the message on how to opt-out of receiving such messages in the future. Still, if We do not include such a link, You may contact Us at support@optiway-app.com to unsubscribe from receiving such messages.

You will receive marketing and informational messages and other news about the Services from Us if You have requested information or purchased the Services or if You have provided Us with Your data when You contacted Us and explicitly indicated that You wish to receive this information.

We may send You the following messages to a targeted set of individuals from Our marketing database: invitations to industry events that We host or attend; informational messages; current industry news; news about the Services We offer; other information that We believe may be of interest to Our Users.

We may also inform You about products or services provided by trusted partners. We may also survey You to determine Your opinion about the Services.

We do not provide lists of Users to third parties in any way, except as outlined in this Privacy Policy.

Information Storing and Deletion

Personal Data shall be processed and stored only for as long as is necessary for the purpose for which it was collected («Storage period»). We apply retention schedules by data category (for example, account data for the life of the account plus a limited period; technical logs for a short period) and delete or anonymize data once the applicable period ends. Inactive accounts may be removed after they are no longer needed for the purposes described in this Policy; where possible, we may notify you using your account email.

We store and process Personal Data only for as long as necessary for the purposes set out in this Policy (for example, for the life of the account and for limited periods thereafter), unless longer retention is required by law. Where processing is based on consent, We store the data until consent is withdrawn or the purpose ends.

The User can delete Personal Data at any time. To delete Personal Data, You need to send us an email at support@optiway-app.com with Your request for Personal Data deletion and the email address used for account creation. We will delete Your Personal Data upon receiving Your request, unless We must retain certain data to comply with legal obligations or to establish, exercise, or defend legal claims.

After the expiry of the Storage Period, We shall delete Personal Data. Therefore, after the Storage Period expires and data is deleted or anonymized, these rights can no longer be exercised in relation to data We no longer retain.

Information Security

We care about the security of Your Personal Data. We adhere to generally accepted industry standards to protect the data transmitted to us, both during transmission, and after it is received. We take technical, physical, and administrative security measures to ensure that Your Personal Data is adequately protected. When We process Your data, We also ensure that Your data is protected against unauthorized access, loss, manipulation, falsification, destruction, or unauthorized disclosure. This is achieved through appropriate administrative, technical, and physical measures.

No method of transmitting data over the Internet or electronic storage is 100% secure. Therefore, We cannot guarantee their absolute security.

We do not use automated decision-making, including profiling, that produces legal effects concerning You or similarly significantly affects You. We may use limited profiling for analytics or marketing only where permitted by law and, where required, with Your consent.

Service Providers and Contractors

We cooperate with third-party service providers who provide Us with services such as App development, hosting of the Website, maintenance, emailing, marketing, technical support and collateral, information technology and cybersecurity services, customer support, and other services. These contractors may access the Personal Data or process it on Our behalf as part of their services to Us. We limit the information provided to Our service providers to only that which is reasonably necessary to perform their functions.
